Court Process

Where separated couples are not able to reach agreement on all or some of the issues then either party can apply to the Family Court of Western Australia to have the matter decided by the court.

The Family Court has introduced processes that parties must follow before filing an application in the Court.  These requirements are known as Pre-Action Procedures and apply to disputes involving child welfare matters and financial issues.

The object of the Pre-Action Procedures is to control costs and if it is possible for the parties to reach agreement, then for a Form 11 Application for Consent Orders to be filed with the Family Court without the need for Family Court proceedings to be commenced and argued.
