Twelve months after separation either or both parties can apply to the Family Court of Western Australia for a divorce.

If there are children of the marriage under eighteen years of age at the time the divorce application is brought, the parties will also need to satisfy the court that proper arrangements have been made for their children.

There are further requirements if the couples have separated less than two years after marriage.
